The fiqh in general, is a product of later generations. The companions of the Prophet (Peace be upon Him) did not need its emulation into a new branch of knowledge because the law giver (the Messenger of Allah-Peace and Blessings of Allah be upon him) was still among them, their linguistic abilities were unsurpassed and those who narrated Hadith were alive. Checking of a report was therefore not much of a problem. But the Madinite society was not a fossilized society; it was an ever-expanding society, with new situations demanding exercising of one’s mind as to the application of revelational injunctions and the Prophet’s (Peace be upon Him) commandments to them.
